Ethics panel wants list of those with knowledge of facts

The city's ethics commission has requested a "list of all individuals" believed to have information about the conflict-of-interest allegations against Mayor Lionel Rivera, who is accused of having financial ties to a developer who was awarded a city contract last year to build new facilities for the U.S. Olympic Committee.

Commissioners Stephen Hook and Malham Wakin set a June 30 deadline for attorney Lindsay Fischer, who is representing a local businessman who filed the complaint, according to a June 15 letter outlining their investigative procedures.

"It is the commission's expectation and certainly its desire that individuals who may have knowledge of the facts underlying the complaint will willingly cooperate with the commission in its investigation," the letter states. "Should that prove not to be the case, the commission may exercise its subpoena power."

Hook and Wakin pledged to conduct a thorough investigation.

But the results of that investigation will be kept secret.

"Once the commission has completed its interviews of witnesses and review of documents, it will issue a confidential written recommendation to the City Council," they said in the letter. "That recommendation will consist of findings of fact and conclusions of law together with a determination as to whether the evidence produced during the investigation supports a finding that a violation of the Colorado Springs Code of Ethics occurred."
