Ethics Watch Files Arguments In Morrissey Case

July 11, 2008

Today, Colorado Ethics Watch filed written arguments in favor of its petition to the Denver District Court to compel Denver District Attorney Mitch Morrissey to act on its request for a criminal investigation of Senator Andy McElhany and the Senate Minority Office. The brief was filed in response to a June 27 order by District Court Judge Norman D. Haglund that permitted to parties to submit additional legal arguments.

On June 2, Ethics Watch filed suit against DA Morrissey for his failure to act on Ethics Watch's April 2007 request for an investigation of potential criminal conduct by Senator McElhany and others in connection with the creation of the Senate Minority Office's official website. On June 23, DA Morrissey filed his response to the petition. Judge Haglund's June 27 order authorized both sides to file additional legal arguments by today. The order gave Ethics Watch an opportunity to respond to DA Morrissey's statements to the court regarding his office's handling of Ethics Watch's request for an investigation.
