CREW Files FOIA Appeal Regarding Investigations of Rep. Mollohan

Today CREW filed an administrative appeal from the refusal of the Department of Justice’s Executive Office of the United States Attorneys (EOUSA) to provide any records related to their investigation of former Rep. Alan Mollohan (D-WV), including documents that would answer why Rep. Mollohan was not criminally prosecuted despite clear evidence he violated the law. 

The Department of Justice (DOJ) conducted a four-year investigation of Rep. Mollohan related to $250 million in earmarks that benefitted non-profit organizations of Rep. Mollohan’s campaign contributors, but notified him in January 2010 it had concluded its investigation and decided not to prosecute him.  CREW filed three Freedom of Information Act requests for records related to the investigation in February.  Less than two weeks later, EOUSA denied the request, claiming that disclosure would violate Rep. Mollohan’s privacy.  This denial fail to take into account the significant public interest in Rep. Mollohan’s conduct and DOJ’s decision to close its investigation without bringing charges against him, as well as Rep. Mollohan’s diminished privacy interest in the requested records.
